These Terms of Use ("Terms") govern your access to and use of Pockit Course Builder and related Pockit services (together, "Pockit," "we," "us"), operated by Ian Allan trading as Pockit. By creating an account, creating a course, or otherwise using Pockit, you agree to these Terms. If you don't agree, please don't use Pockit.
You must be at least 16 years old to create a Pockit account or course. If you're using Pockit on behalf of a school, employer, or other organisation, you confirm you have the authority to agree to these Terms on their behalf.
You're responsible for keeping your account credentials secure and for all activity that happens under your account. Let us know promptly if you think your account has been compromised.
You keep ownership of the courses, lesson cards, text, images, and other material you create or upload ("Your Content"). By creating or uploading Content, you grant Pockit a licence to store, display, and make it available as directed by you — including to anyone you choose to share a course with via Pockit's sharing features. This licence exists only so we can operate the service; it ends when you delete the relevant Content or your account, except where a copy reasonably persists in backups for a limited period, or where you've shared it and the recipient retains their own copy.
You're solely responsible for Your Content and for making sure you have the right to use anything you include in it.
When creating a course, you agree not to include:
Pockit is for people creating their own courses, using the Pockit editor themselves. You may not use an AI agent, bot, script, or other automated tool to generate, populate, or bulk-create course content, or to otherwise interact with Pockit's editing features programmatically in place of a human user. This doesn't stop you personally using an AI tool as a writing aid before typing or pasting your own material in — what's not allowed is an autonomous agent operating Pockit, or generating substantial course content, on your behalf without a person actually doing the creating.
Pockit lets you share a course with other people you invite by email. If you invite someone, you're responsible for making sure you have a legitimate basis to share that content with them. Recipients get read-only access to the course you've shared, until you revoke it.
If we reasonably believe a course or account breaches these Terms — including objectionable material, copyright infringement, or automated/AI-agent-created content — we may remove the offending content, and suspend or permanently remove the course or account, with or without prior notice, at our discretion. We'll try to notify you when practical, but serious or repeated breaches may be actioned immediately without warning.
Pockit is provided on an "as is" and "as available" basis. We may change, suspend, or discontinue any part of the service at any time. We'll try to give reasonable notice of anything that affects your access to your own content, but can't guarantee the service will always be available or error-free.
To the maximum extent permitted by law, Pockit is provided without warranties of any kind, and we're not liable for any indirect, incidental, or consequential loss arising from your use of the service. Nothing in these Terms limits any rights you have under the Consumer Guarantees Act 1993 or Fair Trading Act 1986 (NZ) that can't lawfully be excluded.
We may update these Terms from time to time. If we make material changes, we'll take reasonable steps to let you know (such as an in-app notice) before they take effect. Continuing to use Pockit after changes take effect means you accept the updated Terms.
These Terms are governed by the laws of New Zealand, and any disputes will be subject to the exclusive jurisdiction of the New Zealand courts.
